Abstract

This paper aims to investigate the obstacles in the production of material evidence within the context of special rural social security, as well as the impacts of these difficulties on those who depend on it. The study is developed through a systematic literature review and a documentary analysis, focusing on the doctrine, legislation, and applicable jurisprudence regarding the proof of rural service time for obtaining social security benefits, such as rural retirement. It also draws on scientific articles published in high-impact journals, enabling engagement with both classical texts and the state of the art on the subject. The study concludes that, due to the informality prevalent in rural activities and the lack of formal documentation, special insured individuals face significant challenges in gathering adequate material evidence, which can severely compromise the grantin of future social security benefits unless effective alternatives are created by public authorities. The analysis also addresses how these challenges directly affect access to social security rights, and explores the relaxation of testimonial evidence criteria and other measures adopted by courts to mitigate these issues. Thus, the study seeks to contribute to the understanding of the difficulties faced by rural workers and propose solutions that ensure greater fairness in the granting of rural social security benefits.
