Abstract

The final course work, whose theme is penal execution: a responsibility of the State towards the inmate, aims to discuss the current prison scenario in Brazil, which can be affirmed through data as a precarious situation, consequently not fulfilling its main purpose, resulting in a situation where everyone is deprived of their already conquered and guaranteed rights in the legal system. The present work aims to deepen the understanding of the penal execution process in Brazil and emphasize the importance of the State's responsibility in ensuring the compliance of inmate rights, relating the principles of actual penal law and of "nem bis in idem" in the situation where the inmate suffers from the institution of recidivism. Additionally, the work discusses possible State joint liability, considering the expressive number of recidivists in the Brazilian prison system, Questioning the effectiveness of penal execution.
