Abstract

This research deals with the current scenario of brazilian unionism, the guarantees and prerogatives of union leaders for free action in defense of the interests of the category. through a bibliographic review, it aims to analyze since the emergence of trade unions, tracing a brief overview of its concept, historical evolution and the regulation of trade unionism in the legal system, characteristics and function. it will demonstrate the importance and role of leaders in the procedures of agreements and collective agreements with the purpose of representing and defending the rights and interests of workers. the study also addresses an analysis of the legal figures of collective law and how these prerogatives have been treated by the labor courts. its general objective is to analyze that the guarantees and prerogatives of union leaders are protection norms created so that they do not suffer retaliation when developing their functions and interests, as well as specific objectives to discuss the characteristics and functions of the union, highlighting its principles as a right, analyzing its prerogatives and guarantees and how they should be applied in jurisprudence in labor courts. the methodology used in this article was a bibliographical review through books, articles, magazines in physical and online consultations.
