CHILD SEXUAL ABUSE AND LAW 13.431/17

Abstract

The present study deals with child sexual abuse and Law 13.431/17, which provides for the system of guaranteeing the rights of children and adolescents who are victims or witnesses of violence. The objective is to contextualize the scenario of sexual abuse of these people, extolling the rights and duties imposed by legislation, in the search for effective protection for minors under 18 who are victims or witnesses of sexual abuse. The theme becomes relevant due to the recurrence of violence of this type in our society and how much the psychological of the child and adolescent, victim of abuse, is compromised and, even more, when in a judicial process it is re-victimized, having to remember everything they have experienced. . For this purpose, an exploratory literature review was used as a methodology, through the SciElo and Google Scholar databases. And, it was possible to conclude that victims and witnesses of the crime of sexual abuse needed the regulation reached by Law nº 13.431/17, guaranteeing a specialized service, with all the fundamental detailed procedure for carrying out the assisted hearings.
