SEXUAL ABUSE AGAINST CHILDREN: THE OMISSION OF THE COMPLAINT BY THE RESPONSIBLE

This article sought to answer the question of whether those responsible should be held criminally responsible for failing to report sexual abuse against children. In order to arrive at the solution, the general objective was to analyze the responsibility of parents or guardians for the complaint. We sought to analyze what the legislation says on parental responsibility; making an association of legal provisions for child protection. To reach the objectives, a literature review was carried out. If you look at all cases of violence against children, the aggressors in most cases are part of broken families. The aggressors are usually people who have gone through some trauma in their childhood and may even be sexual abuse. There are few convictions for the crime of abandonment, and the offending parents are rarely convicted in the Judiciary. Taking into account that abandonment is the gateway to other types of crimes, it is important to have stricter practices in the applicability of penalties to delinquent parents, in order to avoid crimes of violence against children and adolescents.
