This article addresses religious freedom, it is a fundamental principle in Brazilian law. However, it is still difficult to implement the defense of this right, even though Brazil calls itself a secular country. The issue worked in this project was the difficulty in reporting the crime of religious intolerance, either for operational reasons, or even because of the non-employment of laicity in the Brazilian government. Thus, a bibliographic research was carried out using scientific articles. In this, it was detected the importance of understanding the Brazilian historical context and how it affects the religious freedom of the population, considering that african religions suffer violence by people who mostly have racist justifications. From the information obtained, a reflection was carried out on the role of Brazilian law in guaranteeing the Right to Religious Freedom to all religions and it was noted that one of the main reasons for the violence suffered by Afro-Brazilian religions go unpunished is due to the lack of understanding of the judicial system of the influence of racism on contemporary Brazilian society. It is concluded that crimes involving religious intolerance are considered minor problems. Thus, the denunciations of these crimes mostly do not even exist.
