THE RESPONSIBILITY OF PEACEKEEPERS WHEN INCURRING CRIMES WITHIN THE COMPETENCE OF THE INTERNATIONAL CRIMINAL COURT

This paper proposes to analyze the immunities granted to soldiers in UN peacekeeping missions and to challenge them as Peacekeepers commit crimes equivalent to those prosecuted in the specific jurisdiction of the International Criminal Court. Knowing that such immunity is a guarantee already consolidated by the International Court of Justice, what is intended is to build a critical understanding of the damage caused by a soldier who is allowed to enter the territory of other states in order to protect people from serious violations of international human rights or international humanitarian law, and yet commits serious crimes against that same population. In order to establish a response or approach a doctrinal solution, what this paper will seek to understand is the possibility of ICC jurisdiction over these agents only when the aforementioned situations touch on the four crimes governed by the Rome Statute, namely, crimes against humanity, genocide, war crimes and aggression.
