THE DRUG DEALER AND USER AS MAXIMUM FIGURES OF THE ENEMY'S CRIMINAL LAW IN THE DEMOCRATIC STATE OF LAW

The present research aims to present the bibliographic study carried out about the legal provisions present in the scope of Law nº 11.343/2006, current Brazilian Drug Law, which comprise tools that promise to be able to repress drug trafficking, this responsible for starting criminal careers and spreading fear and insecurity in society due to the cruel and sneaky way in which he usually acts. Likewise, the analysis proposed here aims to highlight the treatment given to drug dealers and drug users in Brazil, both procedurally and in the media, a treatment that is responsible for the suppression of some procedural principles and guarantees provided for in our constitution, consequently leading to the conclusion that there are still ramifications of the Enemy's Criminal Law Theory in our legal system, more precisely in the anti-drug legislation, with the main exponents of the drug user and drug dealer.
