The present work is intended to bring up a discussion on such an important subject which is the prison system, highlighting the activity of pedagogy as an institute of social inclusion. In this context, it seeks to highlight the teacher's work in the reconstruction and transformation of inmates who propose to be students, seeking a new condition of life and opportunities. To enable a better understanding of the subject, the analysis will be focused on bibliographical research by renowned authors who speak on the subject, as well as using research on legislation and other regulations that deal with education issues in general, such as the Brazilian Federal Constitution, Law guidelines and bases of national education. With this research, it is intended, in the end, to be able to demonstrate and clarify the need for pedagogical activities in the prison context.
