This article presents a study on the Judicialization of the right to health in Brazil and the causes of this legal phenomenon. The role of the 1988 constitution that brought the right to health into a list of social rights will also be addressed, as well as the tripartition of powers and the role of each power. It is also ready to address the role of the state as guarantor and provider of essential rights to the dignified life of the human person, showing the reality of poor public administration, a consequence, the impacts caused by the non-realization of the right to health and precariousness faced in the Health System.
