THE IMPACT OF DECRIMINALIZING MECHANISMS ON BRAZILIAN CRIMINAL LAW FROM 2020 TO 2025

Research indicates that, between 2020 and 2025, mechanisms for decriminalization and the diversion of cases from the criminal justice system have contributed to a significant reduction in excessive criminalization, thereby fostering a more individualized and proportionate approach to justice—particularly regarding minor offenses. Did these mechanisms effectively contribute to social pacification, or did they heighten the perception of impunity in Brazil during this period? Thus, the general objective is to analyze whether these mechanisms have aided in social pacification or reinforced the sense of impunity. Specific objectives include investigating the social and legal effects of applying these measures, evaluating their practical efficacy in conflict mitigation and the promotion of restorative justice, and outlining key doctrinal debates regarding their application in Brazil during the specified timeframe. This study employs a bibliographic review methodology and is classified as qualitative research. The results indicate that such mechanisms have the potential to foster social pacification and rationalize the criminal justice system; however, their effectiveness depends directly on factors such as proper application, institutional strengthening, and the generation of empirical data to allow for a more precise assessment of their impact.
