Abstract

The research is based on the observation that, although Resolution No. 996/2023 of the National Traffic Council regulates the classification of electric micromobility vehicles, the current regulatory framework still presents limitations that hinder the enforcement and effective control of these vehicles on public roads. In light of this scenario, the study sought to analyze the challenges of traffic enforcement, the legal complexity of holding operators accountable, and the implications of the absence of vehicle identification mechanisms. The investigation further reveals that the growing circulation of self-propelled vehicles, combined with the lack of specific requirements for their operation, contributes to increased risks to road safety. Additionally, the underreporting of incidents in official records, resulting from the absence of a specific category for these vehicles within the BATEU system, hinders the production of accurate diagnoses regarding their involvement in traffic accidents. Methodologically, the study adopts a qualitative approach based on documentary analysis, regulatory review, and triangulation of indirect data. The findings indicate that the current regulatory limitations compromise enforcement activities, the accountability of those involved, and the production of reliable data on electric micromobility. It is concluded that improving the regulatory framework, updating reporting systems, and strengthening statistical transparency constitute essential measures for promoting road safety and developing evidence-based public policies.
