LEGAL REGARDING DISINFORMATION: IMPACTS ON POLITICAL AND SOCIAL DEVELOPMENT

Abstract

The disinformation of untruthfu contente in the public sphere has been the subject of debate and controversy. Manifesting itself prominently through so called fake news. This phenomenon has established itself as one of the greatest contemporary challenges to democratic stability and the integrity of public debate using communication and information given this scenario, it is essential to highlight that digital technological evolution, although it should act for the benefit of humanity, has been exploited by individuals who aim exclusively at financial profit and power with the omnipresence of social networks, the focus of disinformation has shifted to electoral gain. To achieve this objective, strategies based on “the ends justify the means” are used resulting in ideological actions devoid of ethics. In this context, the legal system is charged with the mission of deconstructing harmful practices that alienate the social body and make democratic coexistence unsustainable. The theme of legal responsibility in the face of political and social disinformation presents itself as a recent and complex field of study, given the lack of specific legislation on the subject its relevance is indisputable both for the present and for future generations. Thus, the present study seeks to analyze the right to freedom of expression. And the necessary protection of honor, both individual and collective, within the scope of the electoral process social.
