This work addresses the effectiveness and ineffectiveness of imprisonment in the Brazilian prison system, analyzing whether prison fulfills its functions of punishment, prevention, and resocialization of the individual. The study aimed to analyze the effectiveness and ineffectiveness of imprisonment in the Brazilian prison system, verifying whether imprisonment fulfills its purposes of punishment, prevention, and resocialization of the individual. Its specific objectives include: understanding the purpose of imprisonment in the Brazilian legal system; analyzing the main problems faced by the Brazilian penitentiary system; and identifying the factors that contribute to criminal recidivism. The research was characterized as qualitative in nature, developed through a literature review. Furthermore, it discusses the role of the State in guaranteeing the fundamental rights of the incarcerated person and the need for more efficient public policies aimed at the social reintegration of the convict. The study has a bibliographic and legal character, based on the Federal Constitution, the Penal Execution Law, and doctrinal understandings.
