RACISM IN THE BRAZILIAN LEGAL SYSTEM AND ITS IMPACTS ON THE PRACTICE OF LAW

This study addressed racism in the Brazilian legal system and its impacts on the practice of law, considering the persistence of racial inequalities in institutions responsible for promoting justice. Although the national legal system has constitutional and infraconstitutional provisions aimed at combating racial discrimination, it was observed that racism continues to be present in a structural and institutional way, influencing access to justice, the actions of legal professionals, and the treatment given to the Black population in the legal field. The objective of the research was to critically analyze racism in the Brazilian legal system and its impacts on the practice of law, seeking to understand how institutional structures and legal practices contribute to the reproduction of racial inequalities. The methodology adopted was based on qualitative research, of an exploratory and descriptive nature, developed through bibliographic and documentary review. This study analyzed books, scientific articles, legislation, institutional reports, and statistical data related to structural racism, the justice system, and the legal profession in Brazil. The results showed that racism manifests itself transversally in legal institutions, especially through selective prosecution, the underrepresentation of Black professionals in legal careers, and the difficulties faced by the Black population in effectively accessing justice. It concluded that, despite normative advances, structural obstacles still exist that prevent the realization of racial equality in the Brazilian legal system, making it necessary to adopt institutional policies and legal practices committed to promoting human rights and social justice.
