THE ABSENCE OF THE CONSTITUTIONAL RIGHT TO HUMAN DIGNITY IN THE PRISON SYSTEM AS AN OPPORTUNITY FOR ORGANIZED CRIME TO OPERATE

The purpose of this research is to demonstrate through the bibliographic study carried out about the Brazilian prison system that there are real obstacles in the search for resocialization in Brazil, whether for structural or managerial reasons, but mainly related to the fundamental rights advocated in our Magna Carta, which, in their absence, accentuate the crisis in which Brazilian prisons find themselves, today taken over by the parastatal control of organized crime, which uses the flaws present in the scope to entice its army to commit crimes, since the State is incapable of to stop such organisms, which focuses on the approaches of the present work, to, at the end of it, reinforce the idea that there are alternatives to combat organized crime and promote resocialization, but nevertheless changes are necessary in the public policies so that one can have a perspective of improvement for the future days.
