Abstract

This research focuses on obstetric violence during labor in Brazil, contextualizing the civil liability of health professionals for practices that violate the rights of pregnant women. Based on this premise, the following question arises: how are health professionals in Brazil held accountable for the practice of obstetric violence during labor? Therefore, this research aims, with the general objective of identifying the main behaviors considered obstetric violence. Following this link, through the specific objectives, it will discuss the most common types of obstetric violence in Brazil; analyze the consequences and possible civil liability of health professionals in cases of obstetric violence; and examine how jurisprudence and doctrine have regulated the conduct of health professionals who commit obstetric violence during childbirth. This study aims to address preventative measures to reduce the high rate of obstetric violence in Brazil today. Therefore, the methodology used in this study was exploratory and bibliographic in nature, guided by a qualitative approach, using legislation, databases, Google Scholar, books, documentaries, scientific articles, and websites. This research is expected to contribute to knowledge about the conduct that gives rise to civil liability generated by obstetric violence during childbirth and the legal criteria for holding healthcare professionals accountable, as well as the need for legal and institutional improvements in addressing obstetric violence. This is due to the importance of consolidating clear norms and guidelines to guide the actions of healthcare professionals, ensuring a humanized, safe, and respectful childbirth.
