SOLE CUSTODY IN CASES OF DOMESTIC VIOLENCE: IMPACTS ON CHILDREN'S WELL-BEING

This article aims to analyze the application of sole custody in cases of domestic violence and its impacts on the psychological and emotional well-being of the affected children. The research is based on the understanding that the home should be a place of protection and affection, not of fear and insecurity, which is why judicial intervention becomes necessary when living with one of the parents poses a risk to the child’s integrity. The methodology used was qualitative, with a bibliographic and documentary approach, based on Brazilian legislation, court decisions, and psychological studies on the effects of domestic violence on children. The discussion seeks to demonstrate that sole custody, in such contexts, is not merely a legal solution but an instrument of comprehensive protection for the child, aimed arestoring emotional balance and ensuring development in a safe environment. It is concluded that Law No. 14.713/2023 represented a significant step forward by strengthening child protection and recognizing the impossibility of shared custody in situations of violence, reaffirming the principle of the best interest of the child.
