Abstract

This study examines the trajectory and circumstances surrounding the creation of Special Courts systems in different countries, contrasting them with the development and characteristics of the Special Courts in Brazil. Starting from the premise that access to justice transcends legal formality, it investigates how these institutions seek to enforce rights, simplify procedures, and reduce costs, while facing historical and contemporary challenges. The research, of a qualitative and bibliographical nature, uses the deductive method and the comparative procedure, analyzing theoretical and normative sources to identify convergences and divergences in approaches to the democratization of the judicial system and the inclusion of those under its jurisdiction.
