OUTSOURCING IN LABOR LAW: IMPACTS, CHALLENGES AND LEGAL PERSPECTIVES

Outsourcing in labor law is a widely debated topic in the Brazilian legal sphere, especially after the 2017 Labor Reform, which allowed unrestricted outsourcing of activities, including core business functions. This study aims to analyze the impacts of the new regulation on labor relations in Brazil, investigating its effects on the protection of workers’ rights and on the accountability of contracting companies. The research problem seeks to understand how the changes introduced by the reform have influenced the dynamics of labor relations and the effectiveness of the labor guarantees established in the Federal Constitution. Using deductive, dialectical, and historical-evolutionary methods, combined with bibliographical, documentary, and jurisprudential research, the study examines the normative evolution of outsourcing and its practical repercussions. The results indicate that, although the expansion of outsourcing has generated gains in efficiency and business flexibility, it has also led to greater precariousness of working conditions, inequality between direct and outsourced employees, and difficulties in holding contracting companies accountable. Therefore, the study achieves a critical and balanced understanding of outsourcing within the contemporary legal context, contributing to academic debate and to the improvement of labor protection in Brazil.
