Abstract

Criminal factions have been, since their inception, an enemy of public security and the State. In Brazil, they have deep roots in society and affect the daily lives of many people. These organizations dedicated to committing crimes have well-defined structures and resemble companies in their configuration. This work will be based on a literature review conducted through articles, research, jurisprudence, and legislation addressing criminal factions, focusing on the two main ones that govern Brazilian territory: Primeiro Comando da Capital (PCC) and Comando Vermelho (CV), providing an understanding of how they originated and expanded, and how they became large criminal organizations. It will also relate the crimes committed by them according to the current penal classification in Law No. 12.850/2013 and the changes made by the Anti-Crime Package, Law No. 13.964/2019. The aim is to obtain data on measures adopted to combat and prevent these crimes. Thus, it is established that the State must strengthen investigations, public security, and even encourage inclusive public policies to discourage younger people from joining criminal factions.
