INTERDISCIPLINARITY: CONTRIBUTION TO THE JUDICIAL PROCESS OF CHILD CUSTODY IN CASES OF PARENTAL ALIENATION

Interdisciplinarity emerged as a field of study and practice in the 1970s, driven by philosophical questions about the nature of knowledge and learning. Its dynamic and heterogeneous concept involves the integration and interaction between different disciplines, seeking a more comprehensive understanding of complex themes and promoting dialogues capable of transforming areas of knowledge and generating new knowledge in the academic and professional context. Interdisciplinarity proposes a more holistic view of knowledge, challenging the traditional fragmentation of disciplines. This approach requires the adoption of innovative methodologies and collaborative strategies that allow for a broader understanding of the phenomena studied, overcoming the barriers imposed by strictly disciplinary approaches (FAZENDA, 2012).
By promoting an exchange between different areas of knowledge, interdisciplinarity establishes legitimate connections between concepts, methods, and perspectives, enabling the construction of an environment of dialogue and cooperation. This approach recognizes the complexity of the contemporary world and the need to integrate multiple perspectives to understand and solve problems more effectively (FAZENDA, 2011).
In the legal field, interdisciplinarity has proven essential, especially in issues involving multiple social, psychological, and legal factors. The complexity of custody proceedings and the implications of parental alienation are examples of situations that demand an interdisciplinary approach, articulating contributions from Law and Legal Psychology to understand family dynamics and the psychological impacts on the children involved (DIAS, 2024).
Parental alienation, characterized by acts of one parent that negatively interfere in the child's relationship with the other parent, can generate significant psychological damage, requiring a careful and multidimensional analysis (DIAS, 2024). Legal Psychology, by interacting with Law, contributes to the understanding of these processes through technical evaluations, reports, and expert opinions, providing support for more grounded judicial decisions aligned with the well-being of the child (SILVA, 2007).
Given this scenario, this research seeks to explore how interdisciplinarity between Law and Psychology can assist in resolving conflicts in custody proceedings involving parental alienation. Using a bibliographic approach, it analyzes the relevance of collaboration between these areas in constructing fairer and more effective judicial decisions, guaranteeing the protection of children's rights.
Furthermore, the research examines theoretical conceptions of interdisciplinarity, differentiating it from concepts such as multidisciplinarity and pluridisciplinarity, and highlighting its applicability in the legal context. The analysis also aims to understand how legal and psychological professionals can work together to prevent and mitigate the effects of parental alienation, contributing to a more humane and efficient justice system (BUOSI, 2012).
The methodology adopted is based on a systematic literature review, considering theoretical contributions that emphasize the importance of interdisciplinarity in resolving family conflicts. The qualitative data obtained allow for an interpretative analysis of the conceptions of the authors studied, enabling a deeper understanding of the role of Legal Psychology in mediating custody processes and in formulating strategies that prioritize the well-being of the child.
1.1 OBJECTIVES
1.1.1 General Objective
To analyze how the interdisciplinarity between Law and Psychology contributes to judicial decision-making in custody cases involving parental alienation, researching whether the joint action of these areas impacts conflict resolution, the protection of the best interests of the child, and the construction of well-founded and humanized decisions.
1.1.2 Specific Objectives
To analyze how the interdisciplinarity between Legal Psychology and Law can contribute to the resolution of family conflicts in custody cases involving parental alienation;
To investigate the main aspects of parental alienation and its consequences for the emotional and psychological development of children and adolescents;
To identify challenges and limitations faced by professionals involved in the judicial process of child custody with parental alienation, including issues related to communication between professionals, division of responsibilities, and conflicts of interest;
To recommend guidelines for strengthening interdisciplinarity in the context of the judicial process, aiming to improve the quality of assessments and supporting judicial decisions to promote the rights of children and adolescents.
