Abstract

This article sought to discuss obstetric violence from a social and legal perspective, and through bibliographic research, presented the birth plan as a mechanism for preventing this type of gender-based violence. Reproductive rights are constitutionally enshrined as personality rights, and obstetric violence, in turn, constitutes a violation of these rights. In the absence of a specific law, humanized childbirth is a subjective right, fully guaranteed by the Brazilian legal system. It is noted, however, that the humanization of childbirth is slowly progressing toward its recognition as a fundamental right. It was observed that, when implemented, the birth plan empowers women and prevents violence. Even so, its application in healthcare systems is rare. The conclusion is that it is imperative that healthcare professionals be informed about the existence, importance, and guidelines for developing and implementing the birth plan.
