LEGAL RECOGNITION OF NEW FAMILY ENTITIES IN LIGHT OF HUMAN RIGHTS

The concept of family has undergone significant transformations, reflecting contemporary social and cultural changes. New family arrangements—such as single-parent, same-sex, and multi-parent families—are gradually being recognized, shifting the focus from traditional structures to bonds based on affection, care, and individual dignity. In this context, human rights play a central role in promoting equality, inclusion, and legal protection for these configurations. This study, conducted through bibliographic and documentary research, aimed to analyze how constitutional principles, especially the dignity of the human person, have supported the legal recognition of new family entities. It was found that, despite jurisprudential and normative advances, challenges persist due to social resistance and legislative omissions. Therefore, the full realization of fundamental rights depends on the State's continued commitment to ensuring that all forms of family organization receive recognition and protection consistent with democratic values and human rights.
