Fraud involving instant bank transfers (PIX) has become increasingly frequent with the rise of digital financial institutions, causing immeasurable losses to consumers. This issue raises the question of who should bear responsibility for such damage. This research aims to analyze the civil liability of banking institutions toward their clients, based on legal doctrine, case law, and especially Superior Court of Justice (STJ) Precedent 479 and the Consumer Defense Code. It also seeks to discuss the effectiveness of the measures adopted by banks to prevent fraud in PIX transactions and to protect consumers.
