THE EVOLUTION OF FAMILY RIGHTS IN THE BRAZILIAN CIVIL CODE: A LEGAL AND SOCIAL ANALYSIS

This article analyzes the evolution of family rights in Brazil, with an emphasis on legislative and jurisprudential changes that have occurred in the Civil Code, especially after its reformulation in 2002. The research investigates how these transformations have reflected the recognition and protection of various family arrangements, such as stable unions, same-sex families and multi-parenthood, highlighting the appreciation of affection as the foundation of family relationships. Based on a consolidated theoretical framework and jurisprudence of the STF and STJ, the study highlights a constitutional reinterpretation of Family Law, guided by the dignity of the human person, equality and solidarity. The methodology used is bibliographic, with a qualitative approach and descriptive nature. The results point to an inclusive evolution in the legal recognition of Brazilian families, confirming the hypothesis that the flexibilization of traditional concepts has promoted greater protection and equity in contemporary family relationships.
