Abstract

This present study initially aimed to examine the current scenario in the Brazilian judicial system and the causes that lead to procedural delays, exposing, through concrete cases as well as through the current legislation, which constitutional principles are affected by procedural delay. Furthermore, it presented the ethical, social, and legal challenges arising from the use of artificial intelligence in the Brazilian judicial system, including resolutions from the CNJ that already address the use of AI and its limits of applicability. Finally, concrete cases of AI usage were presented and how the judiciary responded to this usage, exposing through this analysis the prognosis for the use of AI in similar cases.
