Abstract

Civil liability in family law has been gaining increasing attention in Brazil, specifically with regard to emotional abandonment. Traditionally, this discussion focuses on parental neglect of their children, but a new phenomenon has been increasingly debated: reverse emotional abandonment, which occurs when children neglect the care and support of their elderly parents. This article seeks to address the concept of reverse emotional abandonment, its legal and case law basis, in addition to the possible legal consequences for children who fail to fulfill their duties. The general objective is to investigate civil liability in family relationships in Brazil, with a focus on reverse abandonment, seeking to understand its legal and social implications.
