MEDICAL CANNABIS AND EPILEPSY: A LEGAL ANALYSIS OF DECRIMINALIZATION

This paper addresses the use of medical cannabis in the treatment of epilepsy, focusing on the legal analysis of the decriminalization of therapeutic use in Brazil. Epilepsy is a chronic neurological condition that affects millions of people worldwide, and recent studies indicate that cannabis-derived substances, such as cannabidiol (CBD), have shown effectiveness in controlling epileptic seizures, especially in cases of refractory epilepsy. In this context, the present study investigates the legal aspects of medical cannabis use, discussing the legal and social barriers that hinder decriminalization and impact the right to health. It also explores legislative advances and relevant jurisprudence on the subject. The analysis includes scientific evidence supporting the benefits of medical cannabis use, highlighting the improvement in quality of life achieved through this treatment. The objective is to provide a critical perspective on the need for changes in Brazilian legislation, in order to ensure access to appropriate treatment and uphold the fundamental rights of patients.
