THE ROLE OF THE TUTELARY COUNCIL AND THE JUDICIARY IN PROTECTING CHILDREN VICTIMS OF DOMESTIC VIOLENCE: CHALLENGES AND PERSPECTIVES

The research addressed the role of the Child Protection Council and the Judiciary in protecting children who are victims of domestic violence: challenges and perspectives. The objectives were: to analyze the role of the Child Protection Council and the Judiciary in protecting children in situations of domestic violence; to identify the challenges faced by these bodies in fulfilling their duties; and to point out possible solutions and perspectives for more efficient and integrated action. The research problem was to answer the following question: What are the main challenges faced by the Child Protection Council and the Judiciary in protecting children who are victims of domestic violence in Brazil, and what strategies can be adopted to improve this action? The relevance of the study is linked to the importance of strengthening child protection mechanisms, especially in a context in which domestic violence rates are still alarming. Based on the legal framework established by the Child and Adolescent Statute (ECA), the study highlights the role of the Guardianship Council as an autonomous body responsible for ensuring compliance with children's rights, as well as the responsibility of the Judiciary in applying protective measures and holding aggressors accountable. The research points out obstacles such as structural precariousness, lack of technical training, judicial delays and the lack of coordination between the actors in the protection network. It is concluded that overcoming these challenges requires investment in intersectoral public policies, ongoing training of professionals and institutional strengthening of the agencies involved, in order to ensure effective and integrated action in the defense of children in situations of violence.
