CONSUMER LAW: LACK OF INFORMATION AFFECTS ACCESS TO JUSTICE

This article analyzed information as a tool for consumer protection and the impacts of its absence on access to justice and fairness in consumer relations. The research used an exploratory qualitative approach, based on a bibliographic review and analysis of current legislation, focusing on the principles of the Consumer Defense Code (CDC), such as vulnerability, objective good faith, and trust. The study addressed consumer rights, supplier obligations, and CDC protection mechanisms, as well as the consequences of informational asymmetry in decision-making. The results showed that information is essential for balancing consumer relations, allowing consumers to know and demand their rights. Technological advancements have intensified informational vulnerability, highlighting the need for legal protection against abuses and misleading practices. Misinformation perpetuates abusive practices and reduces the effectiveness of consumer legislation. It is concluded that transparency and access to information are fundamental to ensuring justice in consumption. The role of regulatory agencies and consumer education policies is essential to mitigate the impacts of informational vulnerability and promote a safer and more balanced market.
