Adult and Youth Education (EJA) in Brazil is a right guaranteed by the 1988 Federal Constitution and regulated by the National Education Guidelines and Framework Law (LDB). However, it faces significant challenges, such as school dropout rates, inadequate infrastructure, and a lack of specialized teacher training. This study analyzes federal legislation, opinions from the National Education Council (CNE), and decisions from higher courts, emphasizing the need for effective public policies. Furthermore, it is based on authors such as Paulo Freire, João Francisco de Souza, and Dayse Moura to discuss the pedagogy of EJA and its role in social inclusion. The research reinforces that EJA should not be seen merely as a compensatory form of education but as an instrument of social emancipation, ensuring full citizenship for learners. It concludes that the implementation of intersectoral strategies and the strengthening of EJA are essential for promoting inclusive and quality education.
