ALTERNATIVE SENTENCES AS A SOLUTION FOR THE PRISON SYSTEM: A COMPARATIVE STUDY BETWEEN BRAZIL AND NORWAY

This article aims to investigate the effectiveness of alternative penalties as a solution for prison overcrowding, considering the approaches adopted in Brazil and Norway. Utilizing a mixed methodology that includes literature review, comparative analysis, and qualitative methods, the study seeks to understand how the differences and similarities between the legislations and procedural practices of these countries affect the reintegration of offenders and the social impact of these measures. The analysis reveals that while Norway has a well-structured and humane penal system, with an emphasis on rehabilitation and low recidivism rates, Brazil faces significant challenges in implementing alternative penalties due to a lack of adequate infrastructure, limited resources, and cultural resistance. The proposed recommendations include investments in infrastructure, professional training, promotion of restorative justice, and public awareness campaigns. It concludes that adapting successful practices from Norway can promote a more effective and humane penal justice system in Brazil, contributing to the reduction of prison overcrowding and criminal recidivism.
