THE PSYCHOPATH AND CRIMINAL LAW: ANALYSIS OF THE SECURITY MEASURE AND THE EFFECTIVENESS OF THE BRAZILIAN JUDICIAL SYSTEM

The present work seeks to analyze the criminal psychopathic individual, held responsible for the security measure. We know that in Brazil cases of crimes involving patients with this type of mental disorder are not so recurrent, however it is clear that over time there is an increase in cases of crimes that are the result of disorders like this, consequently, it raises questions about its effectiveness. of the security measure. With the advancement of society and psychoanalysis, it is clear that there is a need for improvements in the way these are treated in the eyes of criminal law, in favor of fulfilling the purposes of the sentence, even in cases other than the restriction of freedom. Finally, concrete solutions will be exposed that aim to improve security measures, reinforcing the idea of a fairer, more effective and humanized system, aiming at the treatment and recovery of individuals in this condition linked to the commission of crimes within constitutional parameters. We conclude with this article that there is a need for a more critical look at the system of security measures in Brazil, with a view to promoting more effective, inclusive justice and in line with the principles of human dignity. Bringing more innovation and humanization to the system that already exists in Brazil, teaming up with nations that treat convicted psychopathy patients with the due respect they deserve.
