THE VICTIM'S WORD IN RAPE: REFLECTIONS ON THE VALUE OF SEXUAL CRIMES IN THE BRAZILIAN LEGAL CONTEXT

The objective of this study is to analyze how the rape victim's word is valued in the Brazilian legal context, identify the factors that influence this practice and discuss the challenges faced by victims in the search for justice in cases of sexual crimes. The methodology used is qualitative and exploratory, based on a bibliographical review of doctrinal works, legislation, investigations and empirical studies related to the topic. The main results indicate that, although the victim's word is often central in rape cases, due to the absence of physical evidence or witnesses, its use as the only piece of evidence can compromise justice. It should be noted that the victim's words must be accompanied by other means of evidence, such as expert examinations and testimonies, to guarantee the robustness of judicial decisions. Additionally, the research highlights the emotional and psychological challenges faced by victims, which can impact the linearity and accuracy of their accounts. To conclude, the study reaffirms the importance of a balanced and critical approach when dealing with victims' testimonies, guaranteeing both their protection and voice and the fundamental rights of the accused.
