THE PHENOMENON OF SPECTACULARIZATION OF CRIMINAL PRACTICES WITHIN TRUE CRIME AND TELEJOURNALISM AND ITS EFFECTS ON THE PENAL SYSTEM

In this article, we initially sought to analyze the historical roots of interest in content that explores criminal cases, most of which are violent, and how the average Brazilian is interested in this content, focusing on true crime productions and television journalism. Through the study of scientific articles, books and monographs on the subject, psychological, social and even economic issues were analyzed, given that in this media sector, the more appealing the content, the more entertained society feels, providing a very profitable financial return to the developer. The desire to see and hear about brutal attacks and homicides originates from different places, but the possibility of differentiating oneself from what is “bad” is one of the main factors, also highlighting the focus of the work on exploring the ideological issues that permeate the phenomenon of this spectacularization, interesting for understanding the increasingly growing media criminal populism in the country and demonstrating the influence of the media on civil society and the Judiciary. With the study of two cases of great national repercussion, namely, the murder of Isabella Nardoni and the nightclub Kiss, the influence of the media becomes more palpable, serving the punitive feeling cultivated in Brazilian society, demonstrating the danger of media action without limits to the Democratic Rule of Law, given the collision with fundamental guarantees and clear violation of due legal process.
