THE PROTECTION OF THE VULNERABLE IN LABOR RELATIONS: CHALLENGES AND PERSPECTIVES IN THE APPLICATION OF LABOR JUSTICE

Abstract

The Labor Justice in Brazil was created to combat inequalities in labor relations and evolve to adapt to social, political, and economic changes. From the first labor laws of the 19th century to the establishment of the Consolidation of Labor Laws (CLT) in 1943, the protection of workers has consolidated as a fundamental principle. The concept of protection for the vulnerable, which prevents the vulnerability of workers against employers, has become central to guaranteeing their rights and dignity. With the Labor Reform of 2017, the figure of the "hypersufficient" emerged, generating debates about the application of the principle of protection and the challenges in balancing negotiation flexibility with worker defense. This study addresses the evolution of Labor Justice, the principle of protection, and the impacts of labor reforms to understand labor protection in contemporary Brazil.
