FINANCIAL SUPPORT: ANALYSIS OF BILL NUMBER 420/22

This article examines Bill No. 420/22, which proposes setting a minimum child support amount at 30% of the current minimum wage. A review was conducted of the Food Support Law (1968), the Federal Constitution (1988), and the Civil Code (2002–2015) to identify potential legal gaps in determining a fair support amount. The bill raises doctrinal and jurisprudential debates, as current practice, in the absence of an agreement between the parties, relies on a threefold assessment to establish a balanced amount based on the needs of the supported party and the means of the provider. If approved, the bill in its current form may hinder the fulfillment of support obligations, potentially resulting in financial strain for the provider and insufficient resources for the recipient’s subsistence.
