THE EVOLUTION OF CONSTITUTIONALITY CONTROL FROM THE 1988 CONSTITUTION

This article aims to analyze the way in which constitutional control has evolved throughout the history of Brazilian law, from the first Brazilian Constitution in 1824 to the current Constitution, of 1988. Thus, the seven Constitutions that the country had will be studied, in order to analyze – in each of them – the way in which constitutional control, its evolutions and setbacks took place. In addition, there is the exploration of the concept of constitutional control and the way in which it can occur in Brazil, in order to understand its functions and innovations. Thus, it is possible to conclude how the constitutional control was established in the country, what external influences it suffered – especially in the first two Constitutions – and how historical contextualization influenced the Constitutions with regard to the constitutional control.
