Abstract

This article aims to describe the sentencing method, which is the appropriate tool for the correct application of the constitutional principle of individualization of sentencing, provided for in Article 5, item XLVI, of the Federal Constitution, making it impossible to create a generic standardization of penalties for crimes. Some of its characteristics, such as how penal individualization occurs, the requirements used for this individualization, its importance, the development of each phase, the importance of knowing the origin of the system currently applied and how it was before. Seeking to explain in a clear and easy way how the individualization of sentencing occurs, a requirement to corroborate the dignity of the human person, a constitutional principle that runs through the entire procedural system. The methodology used to prepare this document was bibliographical research, which is based on a detailed and updated analysis of previously published works on the theory that will guide scientific research.
