Abstract

Given the exposure of workers in open-air work activities and having to face the harsh climate variations of their work environment, it is necessary to study occupational exposure in open-air activities in which, through the analysis of the right to a thermal break that the worker is guaranteed under labor laws and the Brazilian Federal Constitution. Therefore, considering the exposure of workers to climatic temperature variations, actions and legislation are necessary that act to prevent worker health, as well as the performance of Regulatory Standards that act to regulate work practices in which they operate in the prevention and protection of workers who work in the open sky. Following the objective of analyzing the premise of the Federal Constitution and other legislation regarding the worker's protection of their right to a thermal break, with the same export subject to thermal variations as mentioned. Therefore, for the preparation of this work, an inductive bibliographic review was adopted, in which articles and periodicals focused on the theme corroborated its elaboration.
