This article aims to promote and encourage a more clinical and humane analysis in requests for review of alimony amounts. The intention is to prevent the payer from suffering penalties provided for in the Civil Code, including the possibility of imprisonment. The main focus is to guarantee all the rights of the payee, ensuring their adequate support. However, it is crucial to consider the specific circumstances of the payer, such as unemployment or salary reduction, which may justify a review of the established amounts. The proposed approach argues that, in addition to protecting the interests of the payee, a logical and humane analysis should be applied when assessing the financial conditions of the payer. This perspective seeks to balance the dependents' need for support with the responsible parent's real ability to pay, promoting more equitable justice and avoiding extreme situations that may harm both parties involved.
