ORGAN TRAFFICKING: AN ANALYSIS OF ORGANIZED CRIME AND ITS ETHICAL AND LEGAL IMPLICATIONS

Organ trafficking is a complex criminal activity that falls within the broader context of organized crime. In this scheme, victims are often reduced to commodities representing a serious violation of human rights. To understand organ trafficking, it is crucial to analyze the structures and operations of the criminal groups involved that operate at a sophisticated level of organization and are often transnational, which makes coordination and law enforcement even more complex. Therefore, protecting victims and ensuring justice are fundamental aspects in the legal response to organ trafficking, as tackling this crime requires a comprehensive approach that includes the rigorous application of existing laws, the promotion of ethical practices and international cooperation to undo the criminal networks and ensure that human rights are respected and protected. Therefore, the main objective of this study is to analyze how Brazil and other countries are combating this crime, identifying the policies applied both internally and internationally, from the perspective of the protection of human rights. The method used in the research was bibliographic, through studies in scientific articles, theses, monographs, laws and reviews, using a deductive approach. This enabled the search for information where the expected result was the need to strengthen the legal structures and control mechanisms within the health systems supported by effective regulation that guarantees transparency in all organ transplant processes.
