Abstract

Internet use is a reality in Brazilian society, directly affected by facts broadcast on social networks, whether directly or indirectly. It turns out that many users use their networks, but are unaware of the limits that they should observe for a good coexistence and guarantee of rights. It is common to disseminate information that the expression of thoughts published on the internet would be guaranteed by the Federal Constitution of 1988. However, Brazilian legislation, despite ensuring freedom of expression, imposes certain limits on the subject, among them the prohibition of anonymity and the possibility of being subsequently held civilly and criminally liable for their conduct, if it falls within a criminal hypothesis. It is precisely about the possibility of accountability that this scientific research discusses, using the analysis of the limits imposed on people's expression on their social networks and the responsibilities arising from these manifestations. Based on current legal provisions, doctrinal positions and judgments identified in national jurisprudence, selected according to the subject addressed and selected through the use of qualitative research methodology, the research resulted in the writing of a scientific article that presents the hypotheses of limitation of freedom of expression with accountability for excesses.
