This research addresses the evolution and importance of the principle of affection in family law, highlighting how this concept has transformed the interpretation of family relationships in the legal context. Traditionally, family law was based mainly on biological and legal ties. However, the recognition of affection brought a new perspective, valuing the emotional bonds that are established between family members. To prepare this study, the deductive and historical method was used, based on doctrines and current legislation, in order to provide a complete, clear and transparent analysis of the proposed theme. The study adheres to the principled perspective of affectivity, recognizing both its factual prevalence and the legal solidity given to it. In this way, it seeks to contribute to the description of the constituent elements and the contour of the principle of affectivity, offering a more in-depth and updated understanding of its role in family law.
