STRATEGIES FOR ADDRESSING OBSTETRIC VIOLENCE AND ITS CRIMINAL LIABILITY

Obstetric violence is characterized by the use of practices carried out by health professionals in an unnecessary and harmful way to the physical, psychological and sexual integrity of pregnant or parturient women. From this perspective, this article aims to contextualize obstetric violence, addresses concepts from the literature and lists a list of rights violated as a result of this violence. An analysis was made of the most diverse forms of obstetric violence and how they can have consequences not only for the mother, but also for the newborn. He pointed out some state and federal initiatives, such as resolutions, ordinances and bills; however, the legislative flaw remains, since there is no federal legislation aimed exclusively at obstetric violence. In addition to generating legal uncertainty for the victims, this omission by the State promotes the impunity of professionals who, as there is no criminal classification, are only civilly liable.
