Preambularly, it should be noted that an attempt was made to establish the research by exploring the bibliographic base focused on the subject matter of the study, searching for articles, matters related to the theme and jurisprudence, basically from superior courts. The intention is not to exhaust the subject, which is too complex and full of nuances, even more so, in a society like ours, which, although based on the law and the Constitution, positive law still dispenses with a factual reality, only anchoring itself in a form of rhetorical egalitarianism, based on division, before inclusion, mainly in higher castes, there, not only intellectually, but economically wealthy. The fact is that we live in a very unequal society, supported by a culture based on a bad history, which is in no way represented by the legal framework referring to the subject, that is, not only, but mainly, art. 205 of the Federal Constitution, which announces: “Education, a right of all and a duty of the State and the family, will be promoted and encouraged with the collaboration of society, aiming at the full development of the person, his preparation for the exercise of citizenship and his qualification for work.
