This project aims to analyze access to the fundamental right of education for children and adolescents with Autism Spectrum Disorder (ASD), taking into account specific laws and existing statutes created to ensure this right, which is so necessary and important for the formation of a person, using bibliographical research for its justification, through articles, books and judicial decisions that assist and contribute to the right to contentment. Therefore, taking into account the inequality that exists in Brazil, in which quality education is restricted to only a small portion of the population, it is necessary to implement public policies that guarantee this right, as well as regular schools, which need to adopt pedagogical strategies for children with this disorder, so that there is increasingly more inclusion, and a basic need does not become non-existent.
