MAXIMUM TIME LIMIT FOR SECURITY MEASURES FOR PSYCHOPATHS

This work aims to legally analyze the period of protection applicable to individuals with antisocial personality disorder through the application of security measures. In Brazil, current legislation does not stipulate a maximum duration for security measures; however, the 1988 Federal Constitution prohibits the permanence of sentences. In this context, the article is based on judicial decisions from the Superior Court of Justice (STJ) and the Federal Supreme Court (STF), as well as legal literature, to verify how individuals diagnosed with psychopathy should be treated regarding the application of measures of psychopathy. security, as there are no specific legal provisions for these cases. Thus, controversies regarding the culpability of individuals with psychopathy will be analyzed, raising the question of whether they should be subject to security measures and what these measures would be, since there is no hope of a cure for these mental disorders.
