Abstract

This assignment addresses the evolution of the recognition of filiation in Brazilian family law, focusing on socio-affective filiation. The problematization lies in the challenges faced by socio-affective children in seeking recognition of their inheritance rights. The objective is to analyze these challenges comprehensively, aiming to understand the gaps and possible solutions in the succession context. The research is justified by the importance of ensuring equal rights among all children, as established in the 1988 Federal Constitution and reinforced by the 2002 Civil Code. The methodological procedures involve a review of the relevant legislation and analysis of significant legal cases. The significant results and conclusions will be presented after the research is conducted.
